Question

Suppose the imām, in a four-rakʿah prayer, is unsure whether he has prayed three or four, and then gives the taslīm [the closing salām of the prayer]. After the taslīm, some of the maʾmūms [those praying behind the imām] tell him that he prayed only three. In this situation, does the imām say the takbīrat al-iḥrām [the opening “Allāhu akbar” of the prayer] for the fourth, or does he simply stand and recite al-Fātiḥah [the opening sūrah of the Qurʾān] without a takbīr [saying “Allāhu akbar”]? And where does the prostration of forgetfulness come: before the taslīm or after it?

Answer

If the imām, or someone praying alone, is unsure in a four-rakʿah prayer whether he has prayed three or four, he must build on what is certain, which is the lesser number. He counts it as three, performs the fourth, and then prostrates for forgetfulness before giving the taslīm. This is because of what is established from Abū Saʿīd al-Khudrī, from the Prophet ﷺ, that he said: If one of you is unsure in his prayer and does not know how much he has prayed, three or four, let him cast aside the doubt and build on what he is certain of, then prostrate twice before giving the taslīm. If he has prayed five, the two prostrations make his prayer even; and if he has prayed it complete, they are a humiliation for the Shayṭān1. Muslim narrated it in his "Ṣaḥīḥ".

If, however, he gave the taslīm after three and was then alerted to it, he stands without a takbīr, intending the prayer, and performs the fourth. Then he sits for the tashahhud [the testimony recited while sitting in prayer]. When he has finished the tashahhud, the prayer for blessings on the Prophet ﷺ and the duʿāʾ, he gives the taslīm. After that he prostrates twice for forgetfulness, and then gives the taslīm.

This is the best course for anyone who, through forgetfulness, gave the taslīm with part of the prayer missing. For it is established from the Prophet ﷺ that he gave the taslīm after two rakʿahs in ẓuhr or ʿaṣr. Dhū al-Yadayn alerted him, so he stood and completed his prayer, gave the taslīm, prostrated for forgetfulness, and then gave the taslīm.

It is also established from him ﷺ that he gave the taslīm after three rakʿahs in ʿaṣr. When he was alerted to it, he performed the fourth, gave the taslīm, made the two prostrations of forgetfulness, and then gave the taslīm2.
