What is the ruling on shaking hands with a non-maḥram woman, and does it break wuḍūʾ?
Question
The brother M. R. Y., from Darʿā in Syria, says in his question: I was at a gathering where a shaykh was present with us. After a little while a woman came in and shook hands with everyone. When the muʾadhdhin [the caller to prayer] gave the call for the ʿishāʾ prayer, the shaykh got up and prayed. After the prayer I asked him whether a man whom a woman has greeted may pray without performing wuḍūʾ. He answered: If there was no ill intention on either side, either of them may pray without wuḍūʾ. What is Your Eminence’s view of what he said?
Answer
It is not permissible for a man to shake hands with a woman who is not his maḥram [one of the women he may never marry, such as his mother or sister], because he ﷺ said: I do not shake hands with women; because ʿĀʾishah, raḍiya Allāhu ʿanhā, said: By Allah, the hand of the Messenger of Allah never touched the hand of a woman; he took their pledge only by words; and because shaking hands with them opens the way to temptation.
As for touching a woman, there is disagreement over whether it breaks wuḍūʾ. The correct view is that it does not, whether it is with desire or without, for the Messenger ﷺ kissed some of his wives, then prayed without performing wuḍūʾ. Moreover, the basic principle is that wuḍūʾ is not broken except on a sound, clear proof, and there is no sound, clear proof in this issue showing that touching her breaks wuḍūʾ. Furthermore, this is something that touches every household, so had touching a woman broken wuḍūʾ, the Messenger ﷺ would have made it clear to all.
As for His saying, Exalted is He: ﴿أَوْ لامَسْتُمُ النِّسَاءَ﴾ "or you have touched women" [al-Māʾidah: 6], what is meant by it is intercourse, as Ibn ʿAbbās and a group of scholars said, not touching with the hand, according to the more correct of the two scholarly views1.
