The ruling on delaying ḥajj when one is able
Question
Your Eminence! This letter concerns ḥajj. The sender, your brother in Allah, Jābir Yaḥyā al-Shawfī al-Mālikī, says: A man has gone a long time without performing ḥajj, although he has the provisions and the means of transport, and he claims that he is unable to perform it. What is the ruling on him?
Answer
In the name of Allah, the Most Merciful, the Bestower of mercy. All praise is for Allah, and may Allah send blessings and peace upon the Messenger of Allah, upon his family and Companions, and upon whoever follows his guidance.
To proceed: ḥajj to the Sacred House of Allah is an obligation on every man and woman who is able to find a way to it, because of the saying of Allah, Glory be to Him: ﴿وَلِلَّهِ عَلَى النَّاسِ حِجُّ الْبَيْتِ مَنِ اسْتَطَاعَ إِلَيْهِ سَبِيلًا﴾ "Ḥajj to the House is a duty owed to Allah by people, for whoever is able to find a way to it" [Āl ʿImrān: 97].
So whoever has the provisions and the means of transport, and has the ability to perform ḥajj, yet stays behind, has committed a grave major sin and a grave wrong. He must repent to Allah and hasten to perform ḥajj at the first opportunity he has. He may not stay behind or be negligent about it as long as he is able to perform ḥajj physically and financially. This is a matter on which the scholars agree; there is no disagreement about it. Indeed, the scholars are unanimous that ḥajj is obligatory, given the ability, on all men and women who are legally accountable, if one is able to do it physically and financially. Yes.
